HomeOps Terms of Use

1. Acceptance of these Terms
These Terms of Use ("Terms") are an agreement between you and Peak Download LLC ("Peak Download," "we," "us," or "our") governing your use of HomeOps, a mobile application for organizing home systems, maintenance, records, and planning ("HomeOps" or the "App"). By downloading, installing, or using HomeOps, you agree to these Terms. If you do not agree, do not use the App.
2. Eligibility and use of the service
HomeOps is intended for personal, non-commercial use by homeowners and residents managing information about a home they occupy or are responsible for. You must be able to form a binding contract to use HomeOps. You are responsible for the accuracy of the information you choose to enter.
3. Your account
You need an account to use HomeOps. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Tell us promptly if you believe your account has been accessed without your permission, using the contact information below.
4. Home and profile information
HomeOps lets you enter information about your home, such as home type, year built, HVAC type, and similar details, so the App can organize systems and generate planning estimates. You control what you enter, and you can update or remove it within the App.
5. Your content
HomeOps lets you create records for home systems and appliances, log maintenance activity, and attach documents or photos (for example, manuals, receipts, or warranty information) where the App supports it ("Your Content"). You retain ownership of Your Content. By adding Your Content to HomeOps, you give Peak Download the limited right to store, process, and display it back to you as part of operating the App. You are solely responsible for Your Content, including making sure you have the right to upload any document or image you attach.
6. Acceptable use
You agree not to: use HomeOps for any unlawful purpose; attempt to gain unauthorized access to HomeOps, other users' data, or the systems behind it; upload content that infringes someone else's rights or that you don't have permission to store; interfere with the normal operation of the App; or reverse-engineer, decompile, or attempt to extract the source code of HomeOps except as permitted by law.
7. Ownership of HomeOps
HomeOps, including its software, design, and branding, is owned by Peak Download LLC and its licensors and is protected by applicable intellectual property laws. These Terms do not grant you any ownership interest in HomeOps — only a personal, limited, non-exclusive, non-transferable license to use the App in accordance with these Terms and the terms of the app store you downloaded it from.
8. HomeOps Pro (paid features)
HomeOps offers optional paid features under "HomeOps Pro," available as an auto-renewing subscription purchased through the Apple App Store or Google Play. The subscription price, billing period, and any free trial are shown to you in the App and in the app store's purchase screen before you buy — these Terms do not set or guarantee a specific price, period, or trial, since that information is controlled by the applicable app store and may change over time. Your purchase, payment method, and subscription are handled entirely by Apple or Google, not directly by Peak Download.
9. Subscription renewal and cancellation
Subscriptions purchased through the App Store or Google Play renew automatically unless canceled before the end of the current billing period, as disclosed at the time of purchase. You can review, manage, or cancel your subscription at any time in your Apple ID account settings (App Store purchases) or your Google Play account settings (Google Play purchases). Canceling stops future renewals; it does not retroactively refund amounts already charged.
10. Refunds
Refund requests for purchases made through the Apple App Store or Google Play are handled by Apple or Google under their own refund policies, not by Peak Download directly. If you believe you were charged in error, please contact Apple or Google support for that purchase, or reach out to us using the contact information below and we will try to help point you in the right direction.
11. Restoring purchases
HomeOps offers a "Restore Purchases" option that can reapply a previous HomeOps Pro purchase to a reinstalled App or a new device, where this is supported by the applicable storefront and is associated with the same Apple ID or Google account originally used to buy the subscription. Availability can depend on your account, device, and storefront circumstances, and is not guaranteed in every case.
12. Third-party services
HomeOps relies on third-party services to operate, including cloud hosting and data storage, subscription and purchase management, and product analytics. These providers process information only as needed to provide their service to HomeOps. See our Privacy Policy for more on how information is handled.
13. Maintenance reminders and notifications
HomeOps can schedule local reminders about upcoming or overdue maintenance based on the information you provide. Reminders depend on your device's notification permissions and settings, and on the device operating correctly (for example, having power, being online where needed, and not being in a restricted background state). We do not guarantee that every reminder will be delivered.
14. Home Health scores, lifespan estimates, and cost forecasts — important limitations
HomeOps provides a Home Health score, estimated system lifespans, future cost forecasts, and maintenance recommendations based on general, category-level information and the details you provide about your home. These features are planning tools meant to help you prioritize and anticipate — they are not inspections, appraisals, engineering assessments, or guarantees.
Specifically, HomeOps does not guarantee the accuracy of any estimate, score, or forecast, and these outputs may be incomplete, outdated, or wrong for your specific home, systems, or equipment. Actual lifespan, condition, and costs depend on many factors HomeOps cannot fully know, including installation quality, usage, local conditions, and maintenance history that wasn't entered into the App.
HomeOps is not a substitute for a qualified contractor, home inspector, technician, engineer, financial professional, or other appropriate licensed professional. Before making a repair, replacement, safety, or financial decision, you should have the relevant system or situation evaluated by a qualified professional. If you have a safety emergency — such as a gas leak, electrical hazard, fire, flooding, or structural concern — contact emergency services or a qualified professional immediately; do not rely on HomeOps.
You remain solely responsible for inspecting, maintaining, repairing, and safely operating your home and its systems and equipment, regardless of what HomeOps shows or recommends.
15. Service availability and changes
We may update, change, or discontinue features of HomeOps, and the App may occasionally be unavailable for maintenance, technical issues, or reasons outside our control. We will try to give reasonable notice of material changes where practical, but we don't guarantee uninterrupted availability.
16. Suspension and termination
We may suspend or terminate your access to HomeOps if you violate these Terms, misuse the App, or if required by law. You may stop using HomeOps at any time and can delete your account and associated data using the in-app account deletion option or the instructions at HomeOps account and data deletion.
17. Disclaimers
HomeOps is provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We don't warrant that HomeOps will be error-free, uninterrupted, or secure, or that any estimate, score, forecast, or reminder will be accurate, complete, or timely.
18. Limitation of liability
To the fullest extent permitted by law, Peak Download LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, property damage, or costs arising from a home repair, replacement, or maintenance decision, arising out of or related to your use of HomeOps. To the extent liability cannot be excluded, our total liability for any claim relating to HomeOps is limited to the amount you paid us for HomeOps Pro in the twelve (12) months before the claim arose, or $50, whichever is greater.
19. Changes to these Terms
We may update these Terms from time to time, for example to reflect changes to HomeOps or applicable law. We will update the "Last updated" date above when we do. Continuing to use HomeOps after an update means you accept the revised Terms.
20. Relationship to our Privacy Policy
Our HomeOps Privacy Policy describes how we handle information in more detail and is incorporated into these Terms by reference.
21. Governing law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or HomeOps will be subject to the jurisdiction of the state and federal courts located in Texas, except where applicable consumer-protection law provides otherwise.
