LeagueCast Terms of Use

1. Acceptance of these Terms

These Terms of Use ("Terms") are an agreement between you and Peak Download LLC ("Peak Download," "we," "us," or "our") governing your use of LeagueCast, a mobile application for organizing and scoring amateur sports leagues ("LeagueCast" or the "App"). By downloading, installing, or using LeagueCast, you agree to these Terms. If you do not agree, do not use the App.

2. Eligibility and use of the service

LeagueCast is intended for personal, non-commercial use by league commissioners, captains, players, and other participants organizing or following amateur recreational sports leagues. You must be able to form a binding contract to use LeagueCast.

3. Your account

You need an account to use LeagueCast. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Tell us promptly if you believe your account has been accessed without your permission, using the contact information below.

4. League and user-entered content

LeagueCast lets commissioners, captains, and other users enter names, scores, league and team names, sponsor information, schedules, and other league-related content ("Your Content") so the App can organize and display league play. You retain ownership of Your Content. By adding Your Content to LeagueCast, you give Peak Download the limited right to store, process, and display it as part of operating the App, including showing it to other participants in the same league. You are solely responsible for Your Content, including making sure you have the right to submit it and to share it with other league participants.

5. Acceptable use

You agree not to: use LeagueCast for any unlawful purpose; attempt to gain unauthorized access to LeagueCast, other users' data, or the systems behind it; upload content that infringes someone else's rights or that you don't have permission to share; interfere with the normal operation of the App; or reverse-engineer, decompile, or attempt to extract the source code of LeagueCast except as permitted by law.

6. Ownership of LeagueCast

LeagueCast, including its software, design, and branding, is owned by Peak Download LLC and its licensors and is protected by applicable intellectual property laws. These Terms do not grant you any ownership interest in LeagueCast — only a personal, limited, non-exclusive, non-transferable license to use the App in accordance with these Terms and the terms of the app store you downloaded it from.

7. Commissioner and organizer responsibility

League commissioners, captains, and other organizers are responsible for the accuracy and legitimacy of the league, team, schedule, and scoring information they create or manage in LeagueCast, and for how they administer their league using the App. Peak Download does not organize, sanction, or officiate any league, and is not a party to any arrangement between league participants.

8. Third-party services

LeagueCast relies on third-party services to operate, including cloud hosting, data storage, and authentication. Your use of LeagueCast is also subject to the terms of the app store (Apple App Store or Google Play) through which you downloaded it. See our Privacy Policy for more on how information is handled.

9. Standings, statistics, and scoring — important limitations

Standings, statistics, records, scores, and other results displayed in LeagueCast are calculated or derived from information entered by users and commissioners. This information is provided for recreational and informational purposes only. Peak Download does not independently verify user-entered scores or statistics and does not guarantee their accuracy.

LeagueCast is not an official sports governing body, officiating service, gambling service, or real-money wagering platform, and does not facilitate real-money wagering or betting of any kind. LeagueCast is a scorekeeping and league-management tool for recreational use. You remain responsible for the accuracy and legitimacy of any information you or your league enter and rely on.

10. Service availability and changes

We may update, change, or discontinue features of LeagueCast, and the App may occasionally be unavailable for maintenance, technical issues, or reasons outside our control. We will try to give reasonable notice of material changes where practical, but we don't guarantee uninterrupted availability.

11. Suspension and termination

We may suspend or terminate your access to LeagueCast if you violate these Terms, misuse the App, or if required by law. You may stop using LeagueCast at any time and can delete your account and associated data using the in-app account deletion option or the instructions at LeagueCast account deletion.

12. Disclaimers

LeagueCast is provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We don't warrant that LeagueCast will be error-free, uninterrupted, or secure, or that any score, statistic, or standing will be accurate, complete, or timely.

13. Limitation of liability

To the fullest extent permitted by law, Peak Download LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising out of or related to your use of LeagueCast.

14. Changes to these Terms

We may update these Terms from time to time, for example to reflect changes to LeagueCast or applicable law. We will update the "Last updated" date above when we do. Updated Terms become effective when posted, or on the effective date stated with the update, subject to applicable law.

15. Relationship to our Privacy Policy

Our LeagueCast Privacy Policy describes how we handle information in more detail and is incorporated into these Terms by reference.

16. Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or LeagueCast will be subject to the jurisdiction of the state and federal courts located in Texas, except where applicable consumer-protection law provides otherwise.
